Terms & Conditions

By booking a mentoring session or package, or enrolling in a group program with Anna Mackenzie, you (the client) agree to the following terms and conditions. Please read these carefully before booking or enrolling.

1. Agreement

By booking a mentoring session or package, or enrolling in a group program with Anna Mackenzie, you (the client) agree to these terms and conditions. Part A applies to one-to-one mentoring. Part B applies to group programs, including The Portfolio Career Build Method. The General Terms apply to both. Where there is any inconsistency, the terms specific to the service you have purchased prevail.

Part A: Mentoring Sessions and Packages

2. Scope of Services

Mentoring sessions are provided for the purpose of professional development, career strategy, and business guidance. The mentoring relationship does not constitute and should not be relied upon as legal, financial, or investment advice, or therapy, counselling, or mental health support. All decisions made as a result of our work together remain the client's own responsibility.

3. Session Packages and Expiry

Session packages must be used within the following timeframes from the date of purchase: two-session packages must be completed within 3 months; four-session packages must be completed within 6 months. Sessions not used within these timeframes will be forfeited. Extensions may be granted at Anna Mackenzie's sole discretion in exceptional circumstances.

4. Cancellation and Rescheduling

Sessions may be rescheduled at any time up to 24 hours before the scheduled start time at no charge. Cancellations made within 24 hours of a scheduled session will be charged in full and deducted from the client's package. To reschedule or cancel, please email anna@annamackenzie.com.au as soon as possible.

5. No-Show Policy

If a client fails to attend a scheduled session without prior notice, the session will be considered used and charged in full. No refund or replacement session will be provided.

6. Refund Policy (Mentoring)

All sales are final. Refunds are not available on any mentoring sessions or packages, including unused sessions within a package. By completing a purchase, the client acknowledges and agrees to this policy.

Part B: Group Programs (The Portfolio Career Build Method)

The following terms apply to enrolment in The Portfolio Career Build Method cohort program. Where there is any inconsistency between Part B and the General Terms, the terms in Part B prevail for cohort enrolments.

7. Enrolment and Your Place

Places in The Portfolio Career Build Method are strictly limited. On enrolment, your place in the cohort is reserved for you and is no longer available to anyone else. Your enrolment is a commitment to the full program and the full program fee.

8. Refund Policy (Cohort Programs)

Because this is a small program with strictly limited places, all enrolments are final and refunds are not available once you have enrolled, including where you do not attend or complete the program, or attend only part of it. If you are unsure whether the program is right for you, please book a 15-minute call with Anna before enrolling to discuss fit.

Nothing in this clause limits or excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Payment Plans

Where you choose to pay by instalments, you are entering into a payment arrangement for the full program fee, not a per-instalment right to cancel. By selecting the payment plan you authorise the scheduled second instalment to be charged on its due date.

The second instalment remains payable in full regardless of whether you attend, complete, or withdraw from the program. If the second instalment is not paid by its due date, Anna Mackenzie may suspend or withdraw your access to the program, the community, and all program materials until payment is received, without affecting your obligation to pay the outstanding amount.

10. Facilitators and Guests

Parts of the program may be delivered by facilitators, coaches, or guests engaged by Anna Mackenzie. All materials, frameworks, and contributions delivered as part of the program remain the intellectual property of Anna Mackenzie in accordance with clauses 13 and 14.

11. Recordings and Community Participation

Live sessions, calls, and feedback discussions may be recorded for the benefit of participants. By enrolling, you consent to being recorded and acknowledge that all recordings are the property of Anna Mackenzie. Recordings and program materials are provided for your personal use only and may not be shared or distributed.

The program includes a shared community space and group activities in which participants may see each other's work, questions, and contributions. You agree to keep confidential any personal, professional, or business information shared by other participants, and not to disclose, reproduce, or use it outside the program.

General Terms

The following terms apply to all mentoring sessions, packages, and group programs.

12. Confidentiality

All information shared by the client during mentoring sessions or the program will be treated as strictly confidential. Anna Mackenzie will not disclose any personal or professional information to third parties without the client's explicit consent, except where required by law. The client is similarly asked to treat any frameworks, tools, or methodologies shared by Anna Mackenzie as confidential and for personal use only.

13. Intellectual Property

All frameworks, methodologies, tools, and materials shared during mentoring sessions or the program remain the intellectual property of Anna Mackenzie. They are provided for the client's personal and professional development only and may not be reproduced, distributed, or used commercially without written permission.

14. Intellectual Property and Non-Competition (Group Programs)

All frameworks, methodologies, models, rubrics, tools, prompts, templates, recordings, and written or recorded materials made available through The Portfolio Career Build Method (including, without limitation, the Career Web framework and any AI coach or prompts provided) are and remain the sole and exclusive intellectual property of Anna Mackenzie.

They are licensed to you on a personal, non-transferable, non-exclusive basis for your own professional development only. You may not, during or after the program, without Anna Mackenzie's prior written consent:

(a) reproduce, copy, publish, distribute, sell, license, or share any program materials with any third party;

(b) use the program materials, frameworks, or methodologies to create, deliver, market, or sell any competing course, program, mentoring, coaching, or product; or

(c) commercially teach, train, or present the program's frameworks or methodologies to others for payment.

This clause survives completion of, or withdrawal from, the program.

15. Limitation of Liability

Anna Mackenzie is not liable for any outcomes, decisions, losses, or damages arising from participation in mentoring sessions or group programs, or implementation of any guidance provided. Results are not guaranteed and will vary based on individual circumstances.

16. Governing Law

These terms are governed by the laws of Victoria, Australia.
